EyePrompt Terms of Use

These Terms of Use (the "Terms") are an agreement between you and Beonbrand Inc. ("Beonbrand," "we," "us," or "our"), a Canadian company. They cover your use of the EyePrompt app (full App Store name "EyePrompt Teleprompter"), our product website at https://eyeprompt.app, and anything else we offer as part of that service (together, the "Service").
Please read these Terms together with our Privacy Policy. Between the two, the Privacy Policy explains how EyePrompt handles your information (in short: everything stays on your iPhone, and we hold no data about you), while these Terms explain the rules for using the Service.
1. These Terms are supplemental to Apple's EULA
EyePrompt is licensed, not sold, to you under Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"), which you can read at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Your use of the app is also subject to Apple's Media Services Terms and Conditions.
These Terms are supplemental. They add to the Apple Standard EULA and do not replace it. If anything in these Terms conflicts with the Apple Standard EULA or Apple's Media Services Terms, Apple's terms govern for that conflict, and the rest of these Terms still apply.
2. Accepting these Terms
By downloading, installing, or using EyePrompt, or by using our website, you agree to these Terms and to the Apple Standard EULA. If you do not agree, please do not use the Service.
If you are using EyePrompt on behalf of an organization, you confirm that you have the authority to accept these Terms for that organization.
3. Your license to use the app
Subject to these Terms and the Apple Standard EULA, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use EyePrompt on Apple devices that you own or control, for your own use, whether personal or in your work.
This license does not let you sell, rent, lease, sublicense, redistribute, or share the app itself, or transfer your license to anyone else, except as the Apple Standard EULA or applicable law allows.
4. Acceptable use
We want EyePrompt to be simple and safe to use. When you use the Service, you agree that you will not:
- Copy, modify, translate, or create derivative works of the app, except where the law says you may despite this restriction.
- Reverse engineer, decompile, or disassemble the app, or try to derive its source code, except to the limited extent that applicable law expressly permits regardless of this restriction.
- Remove, hide, or alter any copyright, trademark, or other proprietary notices in the app or on the website.
- Use the Service to create, record, or distribute content that is unlawful, that infringes someone else's rights, or that violates any law that applies to you.
- Use the Service in a way that breaks any applicable law or regulation, including the recording and consent laws in your area.
- Interfere with or disrupt the app, the website, or the devices or networks connected to them, or try to gain unauthorized access to any part of the Service.
Your content is yours. You own the scripts you write or import and the videos ("takes") you record with EyePrompt. We do not claim any ownership of them. Because the app is local-first and we operate no servers, your scripts and takes stay on your device and are never uploaded to us. You are responsible for your own content, for having the rights to use it, and for following the recording, privacy, and consent laws that apply to you and to anyone who appears in your recordings.
5. Subscriptions and billing
EyePrompt is free to start, with an optional upgrade to EyePrompt Pro. Pro is offered through the App Store in these plans:
- Monthly at $7.99 per month. No free trial.
- Annual at $39.99 per year, with a 7-day free trial for eligible new subscribers.
- Lifetime at $99.99, a one-time purchase (not a subscription).
Prices are shown in the App Store and may be presented in your local currency and adjusted for your region and for taxes. The prices above are examples of our standard pricing and may change over time; the price shown to you at purchase is the price that applies.
Apple processes all payments. Purchases are made through the App Store using Apple's StoreKit. Apple handles the transaction under Apple's privacy policy and Apple's Media Services Terms. We receive no payment card details and no Apple ID information. On your device, the app simply learns that Pro is unlocked.
Auto-renewing subscriptions. The Monthly and Annual plans are auto-renewing subscriptions. They renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for the renewal within 24 hours before the period ends.
Free trial. If your plan includes a free trial, any unused part of the trial is forfeited when you buy a subscription, where Apple's rules require this.
Managing and cancelling. You manage, change, or cancel a subscription, and turn off auto-renewal, in your App Store account settings on your device (for example, iOS Settings, then your name, then Subscriptions). Cancelling stops the next renewal; you keep access through the end of the period you already paid for. The Lifetime purchase does not renew and has nothing to cancel.
6. Refunds
Because Apple sells and processes EyePrompt purchases, refunds are handled by Apple through the App Store refund process, not by Beonbrand. If you would like a refund, request it through Apple at https://support.apple.com/refunds. Apple decides refund requests under its own policies. Any statutory refund or cancellation rights you have under the consumer laws that apply to you still apply, and nothing here limits them.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or free of every defect.
The Eye Contact Score is an estimate, not a guarantee. EyePrompt measures how much of a take you appeared to look at the lens and turns that into a single score, with a confidence value, computed on your device using Apple's Vision framework. It is a guide to help you rehearse and improve, not a precise or certified measurement. It does not change, correct, or alter your eyes or your gaze in any recording; it only measures. Results vary with lighting, camera angle, distance, and other conditions, and the app may show no score when its confidence is low.
No professional advice. EyePrompt is a creative and productivity tool. It does not provide medical, psychological, legal, or other professional advice, and you should not rely on it as a substitute for a qualified professional.
8. Limitation of liability
To the fullest extent permitted by law, Beonbrand and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim, or, if you paid us nothing, will be limited to a remedy of no charge.
Some of these limits do not apply where the law does not allow them. Consumer protections that cannot be waived under the laws that apply to you, including consumer protection laws in Canada and the European Union and United Kingdom, still apply, and nothing in these Terms limits or removes those rights. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
You may also have rights and remedies against Apple under the Apple Standard EULA and Apple's policies.
9. Termination
You can stop using the Service at any time. You can delete your scripts and takes in the app, and you can remove the app from your device, which deletes the app's local data with it, as explained in our Privacy Policy. Managing or cancelling a subscription is described in Section 5.
We may suspend or end your license to use the app if you materially break these Terms or the Apple Standard EULA, or where we must do so to comply with the law. Sections that by their nature should survive, including acceptable use, disclaimers, limitation of liability, intellectual property, governing law, and these general terms, continue to apply after your use of the Service ends.
10. Intellectual property
EyePrompt, the EyePrompt and Beonbrand names and logos, and the app's software, design, text, and other content are owned by Beonbrand Inc. or its licensors, and are protected by intellectual property laws. Except for the license in Section 3, these Terms give you no right to our intellectual property, and all rights we do not expressly grant are reserved.
Your content stays yours. As stated in Section 4, you keep all rights to the scripts you create or import and the takes you record. We claim no ownership of your content and, because the app operates no servers and uploads nothing to us, we hold no copy of it.
11. Changes to these Terms
We may update these Terms from time to time, for example to reflect new features, a change in the law, or a change in how the Service works. When we make a material change, we will update the "Last updated" date at the top of this page, and we may note the change in the app's release notes. Your continued use of the Service after an update means you accept the updated Terms. If you do not agree to an update, please stop using the Service.
12. Governing law
These Terms are governed by the laws of Canada and the province or territory in which Beonbrand Inc. maintains its principal place of business, without regard to conflict-of-law rules. This choice of law does not remove any protection given to you by the mandatory consumer laws of the country where you live.
